Over 150 homebuyers have been allegedly duped by city-based SSV developers for Rs 30 crore by not delivering promised flats in Vikhroli area. The Economic Offenses Wing (EOW) of Mumbai Police has registered a case against the developer, who they say did not even have permission to construct the building.
According to the police, the accused builder duped some homebuyers by selling the same flats to multiple homebuyers.The accused allegedly took the booking amount from people, but did not finish the construction, said cops.The police said the home buyers had invested in Vicenza Regency project in Vikhroli area from 2011 and the builder had claimed that the possession of the flats would be given by September 2014. However, the construction was not completed.
"The accused had also sold the same flats to multiple buyers by accepting the booking amount and did not give any possession even after the possession date had passed. It was also revealed that no permission for the construction has been acquired by the builder," said a senior police officer.
An aggrieved buyer Jigar Patel said, "We had invested Rs 21 lakh for three flats in 2011. However, neither have we received possession of the flats nor has the construction been completed. There are over 150 buyers who have invested in different projects of the SSV developers and all of them are waiting for the homes which they had dreamed of."
In 2017, one of the flat buyers, Nikhil Chopra, who had booked Flat No 1002 in the A-Wing of Vicenza project of the builder situated at Vikhroli (East) had also filed a complaint before Maharashtra Real Estate Regulatory Authority (Maha RERA) after the builder did not give the possession of the flat. The RERA had then ordered the builder to pay the amount to the complainant with interest.
When contacted by Mirror, the developer Hemant Parikh, refuted the allegations and said he had offered to a registered agreement with the complainant and also a refund as per RERA norms but it was refused. "The complainant has given us in writing that he wants compensation for delay and hence as per the RERA norms, we paid the compensation of Rs 3.5 lakh. The overlapping of the flat numbers was due to change in planning. All the complainants have signed a consent term with Maha RERA," he said. Source: Mumbai Mirror
